Speedy Process Key To Reduce Litigation Cost For MSMEs: Retired Justice R.S. Sodhi

New Delhi, Aug 18 (KNN) To reduce the cost of litigation for MSMEs it is important to identify materials causing litigation and reduce the time process involved in it, said Retired Justice R.S. Sodhi.

Addressing the seminar on ‘Reducing Cost of Litigation for MSMEs’ organised by Federation of Indian Micro and Small & Medium Enterprises (FISME), he suggested to cut down the time process of litigation in order to reduce the cost of litigation.

He stated that, “Our system and laws are such that only benefit the wrongdoers.”

Delivering the inaugural address he outlined the need for efficient legal system and judicial reforms to minimize the time taken for litigation process.

He emphasised that one of the effective and feasible way to reduce cost of litigation is to reduce number of litigations itself. This could be done by addressing the circumstances leading up to litigations. Further he mentioned how we resolve disputes rather than how to reduce the cost of litigation.

The former Justice of Delhi HC suggested that the judges and the people in the system have to work and should be accountable. The government should be accountable and doing business should be made easy in accordance with the law and there cannot be any grey areas. It should be black and white and explicitly declared to the public.

“Every government official should be accountable for the loss incurred by you. The power comes with accountability. Litigation with the government, when the government loses a case, they should be held liable in a just manner till the affected or aggrieved individual is rightly and reasonably compensated,” he said.

He concluded by stating that the litigation cost can only be reduced when there are results and speedy resolution and by opting for another legal mechanism like arbitration, mediation and conciliation.  (KNN Bureau)
