Cut down in number of days to get a Patent; Patent registered in record time of 113 days

New Delhi, August 26 (KNN) As against to the five to six years’ time involved in obtaining a patent, a patent has been granted to a Hyderabad based drug company, Optimus Drugs,  in a record time of 113 days.  

Talking to KNN, Vedant Pujari, Chief Consultant, FISME-IPFC informed that the Patent Mechanism in India has revamped in the recent past. The time required to obtain a patent has significantly been reduced by a set of steps taken by the Indian Patent Office (IPO).

Listing the initiatives, Pujari said that under the new notifications, there are special provisions for the startups to apply for a patent. Earlier the examination procedure itself used to  take over an year. But with the new provision in place, the startups can now file an expedited examination request, wherein the time taken for examination gets reduced to just three month.

Pujari also informed that the patent office has recently expanded its team by recruiting over 400-500 IPR experts across its offices in the country

Earlier, O.P Gupta, Controller General of Patents, Designs and Trade Marks in a press interview said that for a boost in the innovation across sectors, it is important to have a speedy mechanism for obtaining patents.

According to the amendment in Patent Rules (2003) on May 16, 2016, the authority has introduced `expedited examination' for patents filed by startups, and the enterprises which select India as the competent International Search Authority (or ISAs, with 20 such authorities globally).

He informed that Optimus Drugs was granted a patent on Apixaban within the shortest time. Also 15 other companies have been granted the patent within an year. (KNN/ DA)
