DGFT clarifies that it signs Gazetted Notifications as Authenticating Officer on behalf of the President of India

New Delhi, Sept 7 (KNN) In the wake of several stay orders being obtained from various Courts across the Country on the operation of Notifications from DGFT, the Director General of Foreign Trade (DGFT) has clarified that it signs the Notification published in the Gazette of India Extraordinary Part-II, Section - 3, Sub-Section (ii) as the Authenticating Officer on behalf of the President of India.

In a Trade Notice DGFT said, “It has been observed that there is a confusion about the Notifications signed by DGFT and published in the Gazette of India Extraordinary Part-II, Section - 3, Sub-Section (ii) as having no approval of the Central Government and as a result stay order are being obtained from various Courts across the Country on the operation of such Notifications.”

In this regard, it is clarified that the Notifications published in the Gazette of India Extraordinary Part-II, Section - 3, Sub-Section (ii), by the Directorate General of Foreign Trade, Department of Commerce, Ministry of Commerce and Industry, Government of India are issued with the approval of the competent authority, i.e., Central Government through Commerce & Industry Minister exercising powers conferred under Section 3 of FT (D&R) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020, as amended from time to time, it clarified.

DGFT further clarified that these Notifications are being signed by the Director General of Foreign Trade as the authenticating officer on behalf of the President of India under Government of India Authentication (Orders and Other Instruments) Rules, 2002 and in pursuance of the Order by the Ministry of Commerce.
