Small manufacturers to face brunt of Delhi HC patents verdict

New Delhi, July 24 (KNN) Small-scale, mid-zed manufacturers are likely to face adverse impact of a verdict by a two-judge bench of the Delhi High Court last week, reported Mint.

The impact will be evident on small manufacturers as they licence patents from large international firms.

The court ruled that in the issues pertaining to rights of patentees, the Patents Act overrides the Competition Act and hence the anti-trust regulator cannot probe issues pertaining to rights of patentees, reported Mint.

Appeals moved by Ericson and Monsanto against a Competition Commission of India (CCI) led to this verdict.

Earlier, a single bench of Delhi HC had ruled in favour of CCI, a verdict that has now been overturned.

Big multinational corporations are the major patent holders and often take advantage of their market dominance which impacts small manufactures as their demands are often steep.  (KNN Bureau)
