New Delhi, Mar 31 (KNN) The Ministry of Environment, Forest and Climate Change, last week, notified the e-waste (Management) Rules, 2016, which would be not be applicable to micro enterprises as defined under MSMED Act 2006.

The draft rules were put out by the government June 10, 2015 inviting objections and suggestions on the same. The rule will be called as e-waste (Management) Rules, 2016 and it would be applicable from October 1, 2016.

These rules would be applicable on – every manufacturer, producer, consumer, bulk consumer, collection centres, dealers, e-retailers, refurbisher, dismantler and recycler involved in manufacture, sale, transfer, purchase, collection, storage and processing on e-waste or electrical and electronic equipment listed in Schedule I including their component, consumables, parts and spares which make the product operation, the Ministry said in the notification.

The notification further said that the rules would not be applicable to micro enterprises as defined in the Micro, Small and Medium Enterprises Development Act, 2006.

According to the notification, a ‘manufacturer’ means a person or an entity or a company as defined in the Companies Act, 2013 (18 of 2013) or a factory as defined in the Factories Act, 1948 (63 of 1948) or Small and Medium Enterprises as defined in Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), which has facilities for manufacture of electrical and electronic equipment.
