Experts Panel Discuss WTO Ruling On Transnational Subsidies In New Delhi
New Delhi, Apr 20 (KNN) The Centre for Trade and Investment Law (CTIL), Indian Institute of Foreign Trade (IIFT), in collaboration with the South Asian International Economic Law Network (SAIELN) and the Indian Society of International Law (ISIL), organised a panel discussion in New Delhi on a recent World Trade Organization (WTO) ruling concerning transnational subsidies.
The discussion held on Sunday, centred on the WTO dispute titled European Union (EU) Countervailing and Anti-Dumping Duties on Stainless Steel Cold-Rolled Flat Products from Indonesia (DS 616).
Legal Interpretation of Subsidy Rules
The panel examined the legal and policy implications of the WTO Panel Report, particularly under the Agreement on Subsidies and Countervailing Measures (SCM Agreement).
Discussions focused on the EU’s approach of attributing financial contributions from foreign or state-linked entities to the Government of Indonesia and treating them as countervailable subsidies.
Experts highlighted that the WTO Panel clarified the definition of ‘financial contribution’ under Article 1.1(a)(1) of the SCM Agreement as a closed list, thereby excluding government-to-government inducements from its scope.
Issues Around ‘Public Body’ Classification
The session also addressed the concept of ‘public body’, noting that its determination requires a substantive assessment of an entity’s characteristics and its relationship with the government, rather than a purely formal classification.

Participants discussed the wider implications of the ruling for regulating transnational subsidies and its potential impact on global trade governance.
