Adhere to pollution control norms or face penalty: DPCC tells industry units

New Delhi, Feb 21 (KNN)   With the whole of the Union Territory of Delhi being declared as air pollution control area, it is now compulsory for all industrial units to adhere to pollution control rules with regard to air, water, waste and green category.
 
In this regard, Delhi Pollution Control Committee has issued a notification to all industrial units / establishments engaged in dismantling / cutting of metal scrap with or without use of LPG/Oxygen gas or electric cutters, operating in approved industrial areas / other conforming areas of NCT of Delhi with reference to the master plan of Delhi (MPD-2021).
 
As per the notification, all units will have to fall in line with the new laws or face tough penalty which includes imprisonment upto a maximum of six years.
 
“Under section 21 of the aforesaid Air (Prevention and Control of Pollution) Act, 1981, prior consent of Delhi Pollution Control Committee (DPCC) is mandatory for establishing / operating any industrial plant (any plant used for industrial or trade purposes) in an Air Pollution Control Area,” the DPCC notification said.
 
Further, under section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974, prior consent from DPCC is mandatory.
 
As far as units generating/storing/handling hazardous waste covered under the Hazardous Waste (Management and Handling and Transboundary Movement Rules, 2008 are concerned they are also required to apply for authorisation under the rules.  They should submit an undertaking that the hazardous material would be duly handed over to authorised dealers for its onward recycling /disposal in accordance with the law.
 
Units already in operation in the conforming industrial area or other conforming areas without obtaining consent to establish and consent to operate are liable for action under the provisions of the said Air and Water Acts including penal action of imprisonment upto a maximum of six years. 
 
The same applies to units operating without authorisation under the Hazardous Waste Act.
 
Units which have installed / provided pollution control system / devices (effluent treatment plant / sewerage treatment plant / emission control system are required to properly operate and maintain them to meets the standards prescribed under the Environment Protection Act of 1986.
 
In case the activity of the unit falls under green category, it is mandatory to apply online.  (KNN/ES)
