Gujarat Fixes Rs 300 Stamp Duty for Intra-Family Land Transfers Among Heirs

Gandhinagar, Mar 31 (KNN) The Gujarat government has fixed a nominal stamp duty of Rs 300 for internal land transactions among lineal and collateral heirs, in a move aimed at simplifying property transfers and reducing disputes.

The decision provides relaxation from the existing jantri-based stamp duty system for inheritance-related land transactions, according to an official statement, reported The Times Of India.

Relief for Family Property Transfers

Under the revised provision, when one or more heirs relinquish their rights in favour of other heirs recorded under inheritance entries, a stamp duty of Rs 300 will be levied on each deed of relinquishment.

Similarly, in cases where jointly held inherited land is partitioned, whether in a single instance or over multiple stages, a fixed duty of Rs 300 will apply to each partition deed.

The rule also covers cases where no direct (lineal) heirs are present, allowing transfer of rights to collateral heirs at the same nominal duty.

Aim to Reduce Disputes and Encourage Registration

The state government said the move is expected to ease property division within families, reduce litigation, and promote proper legal documentation of transactions.

Officials noted that high stamp duty had previously discouraged formal registration of such intra-family transfers, often leading to informal arrangements and disputes.

Benefit to Farmers

The policy is also likely to provide financial relief to farmers, particularly in cases involving division of inherited agricultural land, by significantly lowering the cost burden associated with such transactions.

The decision has been taken under Section 9 of the Gujarat Stamp Act and reflects efforts by the state government to streamline land record processes, improve transparency, and reduce legal complexities in inheritance-related property transfers.
