SC stays Rajasthan High Court's order to extend deadline for filing form GSTR-9, GSTR-9C

New Delhi, Feb 12 (KNN) The Supreme Court (SC) has stayed the order of the Rajasthan High Court which extended the deadline for filing of Form GSTR-9 and Form GSTR-9C without fine by up to a week to February 12, 2020.

“We do not intend to interfere with the order passed by the High Court of Judicature for Rajasthan, Jodhpur. However, we only stay that part of the order which has extended the deadline for submitting the returns,” a division Bench of the apex court said.

The Government approached the apex court after the High Court of Judicature for Rajasthan, Jodhpur extended the deadline for submitting the GST returns GSTR 9/9C.

The stay order was passed after Mehta’s submissions that only Rs 200 per day was being charged for the filing of late returns and the amount will be refunded in case the government lost the case.

Reportedly, the Tax Bar Association and Others have filed a writ petition before the High Court of Judicature for Rajasthan at Jodhpur, inter alia claiming that many of its members could not access the portal and, if they managed to, they could not furnish the returns on time.

On February 3, 2020, the finance ministry had again extended the date for filing returns pertaining to FY 2017-2018 to February 5, 2020 for Group 1 and February 7, 2020 for Group 2

GSTR 9 is an annual return form for all assesses (except composition scheme assesses) while GSTR 9C is an audit report to be submitted by assesses with annual turnover of Rs 2 crore or more.
